Terms of Use for Registering as a Caregiver
Between
good souls Pflegevermittlung GmbH, Brunowall 28, 59494 Soest
—hereinafter referred to as the “Agency”—
And
a natural person
—hereinafter referred to as the “User”—
Preliminary note:
The agency maintains a database listing potential, suitable caregivers or nursing assistants.
The user is an applicant seeking to provide nursing services.
Notwithstanding the foregoing, the parties agree as follows:
1. Obligations of the Agent (x) Read and accepted
The intermediary operates a digital platform that lists individuals interested in providing care services and makes this information available to potential employers (specialized facilities/companies or individuals) or trainers for these professions.
The intermediary agrees to make the user’s application available to such prospective employers.
The intermediary is not an employer and is not obligated to ensure the successful conclusion of an employment or apprenticeship relationship.
The user must be informed at all times of the status of the forwarding of their application; the same applies in the event that no suitable employer is available.
2. User Obligations (x) Read and accepted
The user must provide the agency with specific and truthful information regarding all employment-related details (personal information, resume, education, etc.), including any supporting documentation, such as certificates and similar documents.
The user expressly consents to the collection, storage, and, if necessary, disclosure of their data to a potential employer or training provider, to the extent that such data is necessary to fulfill the purpose of the agreement.
The user is further obligated to notify the agency immediately if he or she is temporarily unavailable for placement (e.g., in the case of a fixed-term employment contract or similar).
3. Compensation
The intermediary’s services are free of charge for the user.
Any costs incurred by the user (printing, photocopying, travel expenses, translations, etc.) will not be reimbursed.
4. Liability
The user is liable to the agent for the accuracy and completeness of the information provided by the user.
The agent is not liable for the continuation of an employment relationship resulting from its mediation.
5. Start Date / Duration
This agreement becomes effective upon acceptance of the Terms of Use and is entered into for an indefinite period.
The agreement may be terminated at any time with three months’ notice to the end of the month.
The right to terminate the agreement immediately for good cause remains unaffected; such cause exists only if continuing the agreement would be deemed unreasonable.
Upon the conclusion of a legally binding employment or apprenticeship agreement, the placement agreement shall terminate at that time without the need for a separate notice of termination; this does not apply to fixed-term employment relationships, if any.
6. Miscellaneous
The Agent warrants that it will comply with all applicable regulations governing its activities, particularly those relating to data protection. The User expressly warrants that he or she consents to the disclosure of the data provided to the Agent to third parties, provided that such disclosure is necessary to achieve the purpose of the contract (the conclusion of an employment or apprenticeship relationship).
The user is also obligated to use the data provided to them exclusively for the agreed-upon purpose and to comply with all applicable regulations, particularly those relating to data protection.
No oral side agreements have been made. Any amendments or additions to this agreement must be in writing to be valid; this also applies to any agreement regarding the requirement for the written form.
Any disputes arising from this agreement shall be governed exclusively by German law.
Should any of the above provisions be or become invalid, void, or unenforceable, this shall not affect the validity of the remaining provisions.
The affected provision shall be replaced by one that most closely reflects the parties’ intent, or, alternatively, by the applicable law.
